1. Acceptance of Terms

By accessing the Asheville Herbals website, purchasing any products, scheduling a session, or participating in any offerings provided by Asheville Herbals LLC (“Company,” “we,” “our,” “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please discontinue use of our website or services.

Our intention is to make herbal medicine and traditional healing approachable, understandable, and welcoming. We encourage questions and open communication so you can make informed choices about your health and spiritual journey.

2. Nature of Services

Asheville Herbals provides herbal tinctures, teas, extracts, plant-based wellness preparations, shamanic healing sessions, energetic clearing, ceremonial work, and educational materials.

These services are holistic, spiritual, and educational in nature and are not substitutes for licensed medical or mental-health care. Nothing offered by Asheville Herbals should be interpreted as medical diagnosis or prescription.

3. No Medical Claims & FDA Statement

The herbal products offered are based on traditional wisdom, contemporary research, and practitioner experience.
However, all statements regarding herbs:

  • Have not been evaluated by the U.S. Food and Drug Administration

  • Are not intended to diagnose, treat, cure, or prevent disease

Customers are responsible for consulting a licensed healthcare provider before using any herbal remedy, especially if pregnant, nursing, taking medication, or managing a health condition.

4. Assumption of Risk

By choosing to use Asheville Herbals products or participate in shamanic or energetic services, you acknowledge that:

  • Individual responses to herbs vary

  • Shamanic and energetic work may evoke emotional, physical, or psychological shifts

  • You voluntarily assume all risks associated with these experiences

You agree that responsibility for your wellbeing remains your own.

5. Waiver of Liability

To the extent permitted by law, you agree to release and hold harmless Asheville Herbals LLC, its owner (Joseph Willard), employees, contractors, and affiliates from any claims or liability arising from:

  • Use or misuse of herbal products

  • Participation in shamanic sessions or ceremonies

  • Emotional, psychological, or physical responses

  • Reliance on information we provide

This waiver is not meant to diminish the sincerity or care of our work, but to set clear boundaries that support mutual respect and safety.

6. Client Responsibility

Clients agree to:

  • Seek medical or psychological care when necessary

  • Disclose relevant health conditions prior to sessions

  • Use products only as directed

  • Actively participate in their own wellbeing

Our role is supportive and complementary; your health decisions remain your own.

7. Not a Substitute for Professional Care

Shamanic and energetic healing are supportive modalities, not replacements for medical, psychological, or emergency care.
We do not diagnose conditions, prescribe treatments, or interfere with ongoing medical regimens.

8. Product Use & Purchasing Agreement

By purchasing any herbal product, you confirm that:

  • You are at least 18 years old

  • You understand the traditional nature of the product

  • You take full responsibility for how the product is used

  • You will seek professional guidance as appropriate

Asheville Herbals is not responsible for misuse, allergic reactions, interactions, or contraindications.

9. Refunds, Returns & Cancellations

Because herbal preparations are perishable and crafted in small batches, all sales are final unless the product arrives damaged or incorrect.

For healing sessions:

  • Appointments canceled more than 24 hours in advance may be rescheduled

  • Late cancellations or no-shows may be charged in full

10. Intellectual Property

Asheville Herbals supports the respectful sharing of plant teachings. You may share, print, or reproduce non-commercial educational materials, articles, and teachings for personal study, community learning circles, or spiritual practice, provided proper credit is given.

However, proprietary formulas, product recipes, session structures, or materials explicitly marked as restricted may not be sold, redistributed commercially, or presented as your own work without written consent.

This approach honors both open community education and the integrity of our craft.

11. Communication & Support

We welcome your curiosity. Asheville Herbals is committed to answering questions about:

  • Herbal safety, dosage, or traditional uses

  • How to integrate a product into your wellness practice

  • What to expect in a shamanic session

  • The cultural frameworks and lineages informing our work

If you need clarity, guidance, or resources, we are here to help.

12. Limitation of Liability

Asheville Herbals LLC provides products and services with care, intention, and respect for both tradition and safety.
However, because each person’s experience is unique, we cannot guarantee specific results.
To the extent allowed by law, any liability arising from products or services will be limited to the amount paid for the item or session in question.

This limitation reflects reasonable legal boundaries while honoring the depth of our commitment to your wellbeing.

13. Governing Law

These Terms are governed by the laws of the State of North Carolina. Any disputes shall be resolved in the appropriate state or federal courts of North Carolina.

14. Modifications

Asheville Herbals may update these Terms periodically. Continued use of the site or services constitutes acceptance of the updated Terms.
